We have reviewed your responses of June 20, 1996, July 2, 1996 and July 28, 1996. Our
remaining concerns are outlined below. This letter follows the same format as our adequacy letter
of May 31, 1996. Pursuant to Rule 2.07.4(2)(6), and due to the pending adequacy concerns, the
decision date for the Bowie No. 2 Mine permit application is extended to August 22, 1996.
This letter primarily addresses our continuing adequacy concerns focused on hydrology monitoring
and mass stability of operational and reclaimed areas. Please understand that the geotechnical
stability of the proposed reclaimed configuration is a critical issue at this site. We are unable to
propose any permit decision until BRL has demonstrated that all disturbances can be adequately
reclaimed.
