(C-81-015) <br />Mr. Greg Lewicki <br />Greg Lewicki and Associates <br />1645 Court Place Suite 309 <br />Dear Mr. Lewicki: <br />The Division has reviewed American Shield's application for a <br />Reclamation Only permit and has identified a number of preliminary <br />adequacy issues. Although no coal will be mined and no new <br />disturbance shall occur these issues need to be addressed in order <br />for the Division the process the application. These issues are as <br />follows: <br />1) Applicant information regarding Identification of <br />Interests (2.03.4) is missing some information. Missing <br />information includes: <br />A) In section 2.03.4(3)(d) of the application the <br />statement is made that American Shield has not <br />owned or operated any coal mines in the 5 years <br />preceding this application. Please clarify this <br />section. Additionally, reference to the interim <br />permit (#79-60/UG/C) when the mine was operated by <br />Dorchester Coal Company should be included in the <br />identification of interest section. <br />B) As per regulation 2.03.4(2)(a) and 2.03.4(2)(b) <br />employer identification number of the applicant and <br />resident agent need to be included. <br />C) Information regarding the dates officers and <br />directors of the applicant assumed their respective <br />positions needs to be included. (2.03.4(3)(c)) <br />2) To show compliance with regulation 2.01.6(1) please <br />include proof that appropriate application fees have been <br />paid to the Division. <br />
