-2- <br />PROPOSED DECISION <br />Hayden Gulch Mine <br />The Colorado Mined Land Reclamation Division proposes to approve with <br />stipulations an application for a permit to conduct coal mining submitted <br />by H-G Coal Company for the Hayden Gulch Mine. <br />This approval decision is based on a finding that the proposed operation <br />will comply with all requirements of the Colorado Surface Coal Mining Reclamation <br />Act, C.R.S. 1973, as amended, 34-33-101 et sec., and [he Regulations <br />promulgated pursuant to the Act. <br />The permit application and the stipulations will become a binding part of <br />the permit upon approval. The stipulations for the Hayden Gulch Dline are <br />as follows: <br />1. WITHIN ONE YEAR OF PERMIT ISSUANCE H-G COAL COMPANY MUST PROPOSE TO THE <br />DIVISION AN ACCEPTABLE STANDARD, BASED ON THE RESULTS OF THEIR SITE- <br />SPECIFIC STUDY AND OTHER AVAILABLE DATA, FOR THE DETERMINATION OF <br />RECLAMATION SUCCESS OF WOODY PLANT DENSITY ON THE HAYDEN GULCH SITE. <br />2. H-G COAL COMPANY AND THE DIVISION WILL DETERMINE A MEANS FOR THE EVALU- <br />ATION OF SPECIES DIVERSITY AT THE HAYDEN GULCH MINE AND LOADOUT SITE BY <br />MARCH 31, 1982. <br />Explanations of the stipulations can be found in Section XII of the Findings <br />part of this package. <br />The permit cannot be issued until all statutory notice and public comment <br />requirements have been satisfied, and until bond has been posted. <br />
