a <br />. <br />-23- <br />s, Coal Handling Structures, Support Facilities - Rules <br />2.05.3(71 and 4 <br />The mine facilities, coal handling structures, and support facilities sections <br />of the permit application have been reviewed by the Division. The mini facilities <br />and support facilities portions of the permit application can be found in Section <br />2.05.3 (Volume I), Appendix E (Volume III), Appendix N (Volume V), and Appendices <br />0, P, and Q (Volume VI). Information concerning coal handling facilities can <br />be found in Section 2.05.3 (Volume I). <br />The operation is in compliance with the requirements of this section. <br />XIX. Roads - Rules 2.05.3(3)(c)(i) and 4.03 <br />Based on information presented in Section 2.05.3 (Volume I) of the application, <br />it has been determined that the roads are designed in compliance i~~ith Rule <br />2.05.3(3) and performance standards in Rule 4.03. The operation is in compliance <br />with the requirements of this section. <br />XX. Bonding - Rule 2.05.4(2)(b) and Rule 3 <br />H-G CoaJfompany has agreed to post a performance bond in the amount of <br />$2,223, .00. The Division has determined that this amount will be sufficient <br />to cover the cost of reclamation at the mine (~'~~',°,Q~~`,7) and loadout ($33835&). <br />Pursuant to Rules 2.07.6(2)(j) and 3.02.1(1), tl~e performance bond in this amount <br />will be filed caith the Division, payable to the State of Colorado, before a <br />permit will be issued. <br />XXI. Sealing of Drilled Holes and Underground Openings - Rules 2.05.4(2)(8) and <br />4.07 <br />The Division determined that sufficient detail was lacking with regard to sealing <br />of drill holes, etc. during the review. The applicant has sufficiently- expanded <br />on their drill hole practices in their responses. Based on the information found <br />in Section 2.05.4 of Volume I of the application, the operation is in compliance <br />with the requirements of this section. <br />7C'CII. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, 4.21 <br />No problems were identified with respect to the requirements of any of these <br />sections during the review. Based on information provided in Volume I of the <br />application, the proposed operation is in compliance with all of the requirements <br />of the above sections. <br />XXIII. Operations on Lands Subject to Limitations or Prohibitions - Rules 2.03.7 <br />anA 2.1(1 <br />The proposed operation is in compliance with the requirements of these sections <br />and 2.07.6(2)(d) for the follocaing reasons: <br />
