Sealing of drill holes and underground openings. -MLRD has proposed a <br />stipulation requiring submittal of a reclamation plan for the portal area of the old <br />Apex No. 1 mine, the fan staging area, and the access trail leading to the fan. We <br />believe the applicant's reclamation plan for these areas should be approved prior to <br />permit issuance. By requiring the applicant to develop an approvable reclamation <br />plan before it may receive a permit, MLRD will assure that the reclamation bond <br />amount will be calculated based on all areas to be reclaimed, and may likewise be <br />fixed prior to permit issuance. <br />BLM's comments: <br />On June 3, 1982, the District Mining Supervisor in the Grand Junction office <br />of the BLM indicated that the coal-recovery procedures proposed by the applicant <br />for the Apex No. 2 mine, as well as the potential for future recovery of coal in this <br />area, were acceptable. He recommended approval of the mine plan. BLM's Craig <br />office evaluated the proposed postmining land use and applied BLM's unsuitability <br />criteria to a portion of the permit area. Enclosed is a copy of this office's letter, <br />dated June 17, 1982. <br />USFWS's comments: <br />On February 7, 1983, the Threatened and Endangered Species Office of the <br />USFWS confirmed, by telephone, that there are no threatened or endangered <br />species in the permit area and that, therefore, impacts resulting from mining to <br />such species are unlikely.
