<br /> <br />NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to approve an <br />application for a permit to conduct reclamation operations submitted by the <br />American Shield Coal Company for the Fruita Number 1 and 2 Mines. <br />The operation is located in Mesa County, approximately 12 miles north of <br />Fruita, Colorado. The mine has been reclaimed in 1990 through 1991. No coal <br />will be removed at this mine under this permit. The surface to be affected is <br />privately owned. The permit area encompasses approximately 48 acres in NW <br />1/4, NW 1/4 Section 29, and NW 1/4 Section 30, Township 8 South, Range 101 <br />West of the 6th Principle Meridian. <br />This proposed approval decision is based on a finding that the proposed <br />operation will complywith all requirements of the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S. 34-33-101, et seg., and the regulations <br />promulgated thereunder. <br />Copies of the proposal decision including stipulations, are on file for public <br />inspection at the Colorado Division of Minerals and Geology, Room 215, <br />Centennial building, 1313 Sherman Street, Denver, Colorado 80203 and at the <br />County Clerk's Office in Mesa County, 544 Rood ,4ve., Grand Junction, CO <br />81501. Persons ~.~ith an interest that may be adversely affected by the <br />proposed decision may request a formal hearing before the Mined Land <br />Reclamation board on the proposed decision. Such request must be made within <br />thirty (30) days of the initial publication of this notice, must be in <br />~.aritirg, and must state with reasonable specificity the reascns for the <br />request and the objections to the proposed decision. <br />5030E/scg <br />
