Bax 5300 <br />Denver, Colorado 80217 <br />Re: Variance from Stream Buffer Zone Requirements and <br />Variance from Road Distance Requirements <br />Our File No. C-007-80 <br />Dear Ben: <br />The Division has reviewed and hereby approves a variance from the stream buffer <br />zone requirements of Section 4.05.18 and, in addition, approves a variance <br />from the road distance requirements of Section 2.07.6(2)(d)(iv). With respect <br />to the stream buffer zone variance, for all areas to be disturbed within the zone <br />which are also within the riparian vegetation community as shown on map <br />2.3.6.C, ARCO Coal must submit a reclamation plan no Zater than October 31, <br />1981 which will provide for the reestablishment of appropriate riparian <br />vegetation. However, this does not apply to any riparian areas which have <br />been or will be disturbed as a result of the State Highway Department's <br />highway or river channel relocation operations. <br />Concerning the road variance authorization, the Division's notice of proposed <br />decision approving the variance was published on June 29, 1981 and no comments <br />were received during the 10-day public comment period, which expired on July <br />8, 1981.
