Comments - Compliance <br /> <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Regulations, and the permit also are identified below. <br />Availability of Records <br />All retards and permits should be readily available. <br />The following records were examined: <br />Permit 76-16, approved August 18, 1476 (this did not include <br />the Nlddle Creek underground operations). <br />NPDES monitoring reports. The surface operations are covered <br />by CO-0027154, and discharge from the Middle Creek mine <br />(underground mine water) 1s covered by CO-0036021. <br />Blasting records. No blasting has occurred at Mine No. 3 <br />since September, 1980, and these blasting records were <br />available. <br />Hydrology Monitoring. A surface and ground water monitoring <br />program 1s in progress. <br />MSHA OS-02710. <br />A revision to permit 76-16 to Include the Middle Creek <br />underground operation was approved on August 18, 1978. A copy of the <br />approved letter and a review letter were on file, but the reivtsion <br />request and application could not be located. This should be kept on <br />file with the other Items. <br />HYdroloaic Balance (4.05) <br />Approximately 2-3 gpm of mine water was discharging from the <br />Middle Creek underground mine. The water was running into a sump in the <br />pit and then being pumped into Middle Creek. There was evidence of <br />oxidized iron in the channel to the pit. The NPDES permit was examined <br />and the discharge appeared to be meeting effluent limitations. <br />.~ <br />
