Dept of NKBrat Resources <br />Deaz Mr. Mathews: <br />The Eastside Coal Mine Company is in the process of seeking Land Use <br />permits from Garfield County to operate a coal mine in the unincorporated <br />azea of the County. The County's granting of Land Use permits for the <br />proposed operation is discretionary. The m>Lne is not a use by right in <br />the zone district. Tne public heazing which must be held prior to the <br />County's issuance of such Land Use permits has not occurred. The required <br />County public hearing will probably be held in eazly 1985. <br />Gazfield County has jurisdiction over County Road 237. The right of way <br />for County road 237 is within 100 feet, measured horizontially from a <br />portion of the proposed permit area of the Eastside Coal Mine Company. <br />The County for the purposes of 34-33-114 (2) (g) (IV) C.R.S., as amended, <br />does not object at this time to your agency's consideration of the <br />applicants proposal to include azeas within 100 feet of the County Road <br />237 right of way, within the proposed permit area, including facilities <br />therein. Those portions of the proposed permit azea and facilities within <br />100 feet of the County Road 237 right of way are located and described on <br />map HGP-12 of the Eastside Coal Mine Company's application to the Colorado <br />Mine Land Reclamation Division. <br />7fie County's position, as set forth in this letter, should not be <br />construed or in any way affecting its legal ability under its zoning <br />regulations and applicable state law to impose conditions on the operation <br />of Eastside Coal Mine Company, should its application for land Use permits <br />be approved. Such conditions of approval may include requirements for the <br />maintenance, as well as the improvement of affected County roads, <br />including County Road 237.
