The newspaper advertise-
ment submitted in your application requires some changes to meet the publi-
cation requirements.
Since a large part of your permit application has been requested to be held
confidential, a brief discussion should be submitted (within 10 days) for
the confidential sections enumerating the reasons why they should be held
confidential. The Attorney General is currently working on what information
can and cannot be held confidential. The appropriatness of your request
will be reviewed at that time, so until then, your request for confidentiality
of the information will be honored. Additionally, 2.07.5(2)(a) requires
that confidential material be submitted in a separate volume clearly identified
as being confidential rather than in conjunction with non-confidential
materials. Once a determination is made on the confidentiality of the
information, GEX will be required to take appropriate measures to separate the
confidential information from the non-confidential.
If you have any questions or comments, please give me a call (our number has
been changed to 866-3567).
Sincerely,
Jim Herron
Reclamation Specialist
JH:mab
Enclosure
cc: Richard Fanyo
