The <br />existing mining permit (UC-76) is a Limited Impact Permit <br />that allows only 70,000 tons of coal to be mined annually <br />and it is necessary to acquire a reclamation permit that <br />will not put on such a tonnage limitation. <br />At our current rate of coal production, we will <br />be at the 70,000 ton limit about the first of October of <br />this year. Therefore, according to your advice in a meeting <br />at your offices on July 12, I will start immediate plan <br />preparation of a reclamation plan that will cover only the <br />private lands under lease. The plan of May 21 will h.e_~mended <br />by deleting any reference to federal lands. and by fulfilling <br />the Interim Regulation requirements -- more specifically Part <br />73TUnderground Mining General Performance Standards. <br />The amended permit will be finished and filed by <br />July 20. As you indicated, both the Reclamation Board and <br />Sunflower Energy Corporation are desirous of obtaining this <br />permit as promptly as possible and an approval by the <br />Reclamation Board in the August meeting would be likely. <br />Sincerely, <br />Kenneth L.
