Hoyl and Donald E. Wilde but does
not in any way refer to the present owners' determination to
develop the coal leases. In fact, the application states that
there will be no further mining. We believe this is not true as
the Fruita Mine, or Anchor Tresner Coal Unit, is a large 721
million ton proven reserve of high grade, low sulfur coal. Our
determination to proceed with the project has been conveyed by
word and in writing a number of times to the Mined Land
Reclamation Board.
Further, American Shield Coal Company has been advised that
it cannot do anything at the mine site that would interfere in
any way with our ability to start up the mine - specifically this
referred to roads, benches and entries.
The application submitted completely ignores the needs and
rights of the present leaseholders.
We strongly object to the provisions that alter or change
the benches, the roads and the portals. We are very unhappy to
learn that the entries on the Anchor Seam were dozed over.
We will shortly be inspecting the site to see what further
damage has been done.
We have advised American Shield Coal Company as of November
22, 1988, that "present bonding will remain in place until our
mine plans and permitting are completed."
