D e~• ~'° <br />Dear Dan: <br />This letter modifies the authority to operate which Gras set forth in my <br />correspondence to Colorado lJestraoreland on April 17, 1981. <br />Based on the information you presented in our September 9th meeting and <br />the present status of mine plan reviews, I concur that the April 17th <br />authority should be modified to include: <br />a) Extension of 1 K 2 Plorth Mains to fault <br />b) Extension of 3 Last to property boundaries including extraction <br /> of 6 & 7 tlorth panels <br />It is my understanding that this modification allows an effective production <br />approximating 950,000 tons for 1921. <br />This modification to the April 17 authority is granted with the following <br />conditions: <br />1) Colorado 4estmoreland will conduct all operations under this <br />agreement in full compliance vrith the Colorado approved program <br />and permits issued thereunder. <br />2) Colorado IJestlnoreland agrees to apply any conditions (in addition <br />to those in the State permit) contained in the action by the <br />Secretary to all operations and areas involved under the <br />modification granted by this letter. <br />I believe that this minor modification to the April 17th authority provides <br />for the appropriate continuation of your operation in an environmentally <br />acceptably manner. <br />If you accept the modification and the conditions, please co-sign either <br />this letter or the enclosed copy, as shown, and return to me. <br />Sincerely, <br />Donald A.
