It has come to the attention of the City of Trinidad that Mr.
William Davis doing business as Rimrock Mining Company, is seeking a
permit from your agency for the development of and operation of a
coal strip mine southeast of this City.
From information obtained through Las Animas County, Trinidad has
become aware of Mr. Davis' submissions to your agency with regard to
the disposal of non-coal waste. Mr. Davis has apparently indicated
that waste material from his prospective mining operation is to be
disposed of at the landfill operated by the City of Trinidad. Please
be advised that no such arrangement has been made and without prior
agreement the City of Trinidad has no intention of accepting waste
material or other residuals from Mr. Davis' planned coal mining
operation.
Further, be aware that although a formal action adopting a position
statement has not been addressed by the Trinidad City Council,
nevertheless, the Trinidad City Council is concerned about the
potential environmental impacts that may occur should this mining
operation be authorized.
Your agency is asked to withhold any decision regarding Mr. Davis'
request for a mining permit, affording the City of Trinidad a chance
to formalize its position.
