Lorencito Coal Company revised page 2.05-59 in response to DMG's questions No. 104
and 105. While Lorencito Coal Company's response was suitable, some formatting
problems ensued with page 2.05-59. Pazagraphs 1 and 2 were duplicated on page 2.05-
59. With elimination of the duplicated pazagraphs, the Division will accept this revised
page.
107. Figure 2.04.4-20 was not included with the revised materials.
Rule 2.05.5 Post Mining Land Use
The response to question 109 is adequate. The application is in compliance with Rule 2.05.5.
Rule 2.05.6(1) Air Pollution Control Plan
110. The applicant's response is adequate. However, if the Division does not receive a copy
of an initially approved emission permit (or other equivalent form of permit) by the time
the mine application is ready for approval, the Division will have to stipulate receipt of
the emission permit prior to the operations beginning to which the emission permit
applies.
• Rule 2.05.6(2) Fish and Wildlife Plau
Under this section, all responses were found adequate except as listed below.
111. Correspondence was received from John Woodling of the Division of Wildlife and Chris
Kloster of the Division of Wildlife. Based on our discussion on May 28, 1997, the DMG
will be reviewing this correspondence and will respond to LCC by June 5, 1997 with
regazd to the various issues identified.
Rule 2.05.6(3) Protection of the Hydrolo¢ic Balance
The response to question 112 is adequate. The application is in compliance with Rule 2.05.6(3).
Rule 2.05.6(4) Protection of Public Parks and Historic Places
113. See response under Rule 2.04.4
Rule 2.05.6(5) Surface Mining near Under round MinlnE
114. The applicant has indicated this information will be submitted as soon as it is available.
Therefore, at this time, the response to this question remains inadequate. Also, on page
• 2.05-111 the term "mine plant" should be "mine plan".
