Larry Damtau <br />Permitting Coordinator <br />Colorado Yampa Coal Company <br />BOx 772129 <br />Steamboat Springs, Colorado 80477 <br />RE: Foidel Creek Permit Revision Application <br />C-056-82 <br />Dear Mr. Damtau:• <br />The above referenced application has been reviewed by the <br />Division of Mined Land Reclamation for compliance with the <br />Regulations promulgated pursuant to the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S. 1973, 34-33-101, et sue. This <br />letter and attached comments convey the concecna raised during <br />the adequacy review and constitutes the notification of <br />preliminary findings as requited in Rule 2.07.4(1). Additional <br />information may be requested as the review continues. <br />The permit revision application was delivered to the Office of <br />Surface Mining who subsequently requested comments from the <br />U.S. Fish and Wildlife Service (USFWS), the Minerals Management <br />Service (MMS) and the Bureau of Land Management Service (BLM). <br />The USFWS has no objections or comments and the MMS states that <br />the revision only addresses non-federal coal under non-federal <br />surface and the recoverability of adjacent Federal coal is not <br />expected to be affected. MMS, therefore offers no official <br />comment. The BLM has not yet responded. <br />The major deficiency in the permit revision application celates <br />to the impacts of the underground mine to the hydcologic <br />balance.
