The tenu "kugula[ury Authority" us used hureln means both <br />federal Utficc uP Surface `ti.uine and the Wyuwing Department of <br />Lronmental duality, unless o[hcrwlse specified. <br />The operator agrees [u be bound by the provisions of Section 517 of <br />[he Surface Flininy, Control and Reclamation Act of 1977, 30 USC <br />1261 (P.L. 95-87, hereinafter referred to as "Act"), and agrees to <br />allow the authorized representatives of [he Secretary, without advance <br />notice or a search warrant, upon presentation of appropriate credentials, <br />and without delay, tu: <br />(A) tinter upon or through any surface coal mining and reclamation <br />operations to: <br />(1) Inspect any coal mining and reclamation operation, moni- <br />toring equipment, ur p[ocedure conducted pursuant [u the <br />perms t; <br />(2) Collect s:uoples and other relevant information regarding <br />ale ur water, fish and wildlife, soils, vegetation and <br />other resources protected under [he Ac[, this Chapter and <br />the State program; and, <br />O) Ubtain access to any copy of any records required to be <br />ia:,in[ained uml~,r [he terms and conditions of the permit <br />or Clru regulatory program. <br />(IS) 8c accump,~niuJ by private persons fur the purpose of conducting <br />an inspcr.tion iu accurdauce with 5ectlon S21(u) of the Ac.t. <br />The term "authorized representative of [Ire Secretary" as used in <br />Sec[iou 517 and this paragraph s}rall be construed [o include, but <br />nu[ be limited [u, r:mployees of the United States who are super- <br />vised by, or detailed nr assigned to the Uffice of Surface !Lining, <br />any person under contract who is acting on behalf uC the Secretary <br />or any person employed by [he State Regulatory Authority if it is <br />authorized to regulate surface coal mining operations on federal <br />lands; or any other person identified as an authorized representa- <br />tive by a Letter signed by the Director, Uffice of Surface Pllning. <br />2.
