Since large amounts of the permit area are already disturbed, the Division
suggests that any baseline vegetation samuliny he performed in adjacent areas
with abiotic characteristics similar to those of the mine site prior to
disturhance. The applicant should meet with the Division to determine these
areas prior to sampling.
8. Reference areas may not bc- required if the applicant can demonstrate that
sampling of the baseline area was performed during "normal" conditions o1
precipitation, grazing pressure and other factors as determined by the Division
XIZI. Fish and Gildlife - Rules 2.04.11, 2.05.6(2), and 4.18
Findings:
The fish and wildlife resource statement and the fish and wildlife maraycment
plan sections of the application are found on pages 76 and 135.
The Division has consulted with personnel from the Colorado Division of Po'ildlife
(DOW) caith respect to the llclcn mine. ltar:cc7 upon the consu.itaiion, it has
been determined that there are no major wildlife concerns for this operation.
The mine is located in, or near an area that has been designated as potential
hunting and nesting sites for the P.merican Peregrine Falcon, an endangered
species. DO[J has not located any nesting sites roithin or adjacent to the surface
disturbance associated with the mine. The surface disturbance is located within
hunting grounds for the Peregrine Falcon. !lowever, the value of this area as
hun tiny gz'ounds .is very li.mi tcrl due to prr_vi ous disturbance at the site and
the proximity of large major disturbances, associated with the city of Trinidad.
