Lamm <br />Governor <br />T0: Mike Savage <br />FROM: Jim Pendleton <br />RE: Subsidence A~ <br />MEMORANDUM <br />1 February 1985 <br />iew - Coal Gulch Permit Application <br />Pursuant to your request, I have reviewed the subsidence-related aspects of <br />the Coal Gulch underground coal mine permit application. In the interest of <br />efficiency, we should resolve the following issue before I proceed with the <br />preparation of my technical opinion. In this instance, the critical issue for <br />subsidence-related application compliance is whether or not the potentially <br />affected area contains any renewable resource lands. <br />If the area above the proposed workings does not contain any significant <br />aquifers or areas of recharge to aquifers, no subsidence survey would be <br />required. In this instance, the application states that the only "structure" <br />existing within the area is a light-use four wheel drive vehicle road, for <br />which an appropriate subsidence control plan could consist of appropriate <br />warning signage and periodic visual inspection by the operator. If, on the <br />other hand, the Division were to find that renewable resource lands exist <br />within the potentially subsided area, then life would become much more <br />difficult for Peerless Resources. If renewable resource lands are determined <br />to exist, a significant elaboration of worst possible consequences and <br />technical subsidence prediction would be necessary.
