C-O11-81 <br />Dear Mr. Blake: <br />On March 22, 1983, the Division received your letter with comments <br />regarding the Apex No. 2 permit review from the U.S. Fish and Wildlife <br />Service, the Bureau of Land Management and the Office of Surface Plining. <br />These comments were incorporated into our review. Additional material <br />has been submitted by Sunland Mining Corporation and all of the concerns <br />raised in your March letter have been resolved. The responses to your <br />concerns are addressed below in a topic-response format with references <br />where additional information can be found. <br />Enclosed is a copy of the Division's Proposed Decision and Findings of <br />Compliance for your use in developing the package for lJashington. <br />Cultural Resource - No further disturbance in the permit area is proposed. <br />Postmining Land Use - The postmining land uses of public road right-of- <br />way, wildlife habitat and grazing have been approved in writing by the <br />appropriate landowners (see pages 13.01 and 187.1 of the permit appli- <br />cation). Prior to any mining in the area, there was no county road <br />in the valley. Therefore, a change in land use was necessitated to allow <br />the county road to remain unreclaimed (see Rules 2.05.5(2) and 4.16 of <br />the Colorado Regulations). Pursuant to these regulations, Routt County <br />has requested in writing that the county road remain (see page 13.01 of <br />the permit). <br />Hydrologic Balance: Surface 4Jater - The surface water baseline which had <br />been submitted to the Division separately has now been incorporated into <br />the permit application (see pages 65.1 to 65.73 of the application). <br />Alluvial Valley Floor - The Division's analysis of the alluvial valley <br />floor potential and possible effects is included on pages 14-16 of the <br />findings document. <br />423 Centennial Building. 1313 Sherman Street Denver, Colorado 80203 Tel.
