~1 <br />l~ '~ • <br />Attachment <br />C~ <br />Stipulations <br />Attached to Office of Surface Mining Approval <br />of Minor Modification to Coal Mining and Reclamation Plan <br />for United States Steel Corporation's Somerset Mine <br />(Sunflower Energy Corporation-Operator) <br />Federal Coal Lease C-033301 (E-Seam) <br />1. Under this approval, Sunflower Energy Corporation shall undertake no <br />additional surface disturbance associated with the Blue Ribbon Mine (excevt <br />for mitigation of identified cultural resources, implementation of the <br />subsidence monitoring network, and necessary hydrologic monitoring). <br />2. Under this approval, Sunflower Energy Corporation shall not increase [he <br />monthly rate of coal production above the highest monthl}~ production rate <br />achieved in 1980 at the E1ue Rih bon Pfine. <br />3. If cultural materials are located during the survey to he conducted by the <br />Office of Surface Mining (OSM), they will be recorded by OSM and documentation <br />will be turned over to Sunflower Energy Corporation (SEC). Upon receiving the <br />completed forms, SEC will, within 50 days, in conjunction with OSM, the I1.S. <br />Forest Service, and Slate Iistoric Preservation Officer (SHPO), evaluate and <br />prepare National Register forms for the determination of. National Register <br />eli¢ibility. Additionally, regarding sites threatened by potential <br />subsidence, iC is [he responsibility of SEC [o formulate, within 90 days of <br />receiving Che OSM survey form, a mitigation vlan acceptable to the above <br />agencies and the Advisory Council on Historic Preservation. Preservation <br />and/or mitigation of impacted cultural resources is the responsibility of SF.C. <br />4. If, during mining operations, previously unidentified cultural resources <br />should be discovered, Sunflower Energy Corporation (SEC) shall insure [h a[ the <br />site is not disturbed and shall immediately cease land disturbing activities <br />within the vicinity of Che site and notify the Regulatory Authorities. SEC <br />shall ensure that the resource(s) is properly evaluated in terms of the <br />National Register (3h CFR 60.6). Should a resource be determined eligible for <br />listing in the National Register of Historic Places in consultation with the <br />Regulatory Authorities and the SHPO, SEC shall consult with and obtain the <br />approval of [he Regulatory Authorities and the SHPO concerning the development <br />and implementation of mitigation measures as appropriate. Activities shall <br />no[ resume until these measures have been completed and avprov ed. <br />5. Within 45 days of written acceptance of this approval by Sunflower Energy <br />orporation (SEC), SEC shall submit to the Regulatory Authorities for approval <br />a detailed subsidence moni[orinp, plan to detect effects to Che surface which <br />may result from subsidence. Prior to implementation of the approved <br />monitoring system, SEC shall not engage in the removal of pillars in Section <br />35, T. 12 S., R. 91 W. In addition, within 45 days of written acceptance of <br />this approval, SEC shall suhmit to the Regulatory Authorities a detailed <br />analysis of the extent and anticipated effects of subsidence, a description of <br />
