<br /> <br />Cultural Resources <br /> <br />In accordance with Section 106 of the National H.is[oric Preservation Act of <br />1966 and the "Programmatic tlemorandum of Agreement among [he Rur.eau of Land <br />Management, Office of Surface Mining Reclamation and Enforcement, the United <br />Slates Geological Survey, and the Advisory Council on Historic Preservation <br />regarding the Federal Coal Management Program" (PMOA), Sunflower Energy Corp., <br />in October 1977, contracted with Centuries Research Inc. to cundur_[ a cultural <br />resource survey within the project area of their Blue Ribbon `tine, Delta <br />County, Colorado. <br />The investigations consisted of an intensive ground survey of a 400' by 400' <br />parcel of land proposed for Dortal development and apprma mateiy one-half mile <br />of a flagged proposed access roadway. This survey was conducted on private <br />land which abuts the Gunnison National Forest. The coordinates f.or the parcel <br />are SW1/4 of the NEli4 of the NW1/4 of Sect.ton 2, T.13S., R.91W. No cultural <br />resources were located by the survey except for the recent Rlue Ribbon Mine. <br />As slated in the completeness review of the mine plan by Hittman Associates <br />Inc. (Nov. 20, 1980) and by the Office of Surface Mining (llecember 5, 1980), <br />nn additional cultural resources survey is required. 1n order to expedite <br />matters, the Office of Surface Mining has taken responsibility for conducting <br />a sample cultural resource survey of. [he mine plan area which has potential <br />for post-mining subsidence. <br />Preparatory to the survey, to he completed prior [o July 1, 1991, the Office <br />of Surface 'tieing };as requested a special use permit to conduct an <br />archaeological survey nn Forest Service lands. After the survey is completed, <br />responsibility will again fall to the applicant to carry out and adhere to the <br />fallowing stipulations. <br />A. If cultural materials are located during the survey to be conducted by the <br />Office of Surface }lining, they wi11 be recorded by the Office of Surface <br />`lining and the documentation will be turned over to SEC. SF.C upon receiving <br />the completed survey forms wi11, within 60 days, in conjunction with Office of <br />Snrf.ace A1lning, IJ.S. Forest Service, and Stale Historic Preservation Officer <br />(5111'0), evaluate and prepare National Register forms for the determination of. <br />National Register eligibility. Additionally, regarding sites threatened by <br />potential subsidence, it is the responsibility of SEC to formulate within 90 <br />days of receiving the Office of Surface Mining survey Form, a mitigation plan <br />acceptable [o the above agencies and the :ldvisory Council on Historic <br />Preservation. Preservation and/or mitigation of impacted cultural resources <br />is the responsibility of applicant. <br />R. If, during mining operations, previously unidentified cultural resources <br />should he discovered, SF,C shall insure that the site is not disturbed and <br />shall immediately cease land diseurbin,g activities within the vicinity of the <br />site and notify the regulatory authority. The operator sha11 ensure [hat the <br />resource(s) is properly evaluated in terms of the National Register (36 CFR <br />60.6). Should a resource he determined eligible f.or listing in the National <br />Register of Historic Places in consultation with the Regulatory Authorities <br />and the SHPO, the operator shall consult with and obtain the approval of the <br />Regulatory Authorities and the SHPO concerning the development and <br />irnplementation of mitigation measures as appropriate. Activities shall not <br />resume until these measures have been completed and approved. <br /> <br />
