Cri:ericr ~:;.-per 7i: Idunicipal Ra:ersheds _ <br />Analysis: tlo cunicipal watersheds have been identified ns lying <br />within these coal leases. <br />Cri :erion Number 18: stational Resource Waters _ . _ _ _. _ <br />Analysis: The State of Colorado is presently working on the project <br />of identifying and labeling National Resource Waters. As part of <br />their definition of national Resource Waters. a stream must have <br />perennial or continuous `1 or and be of high quality. capable of <br />supporting_trout fisheries. To data. no water courses in the lease <br />area have been officially designated as National Resource Waters in <br />completed water quality management plans. <br />Criterion Number 19: Alluvial Valley Floors __._ -_ ___, <br />Analysis: The area to which Lhe unsultabillty analysis was applied <br />mey have an alluvial valley floor present on the alluvial ternees <br />adjacent to~•the North fork of the Gunnison River: Assistance from <br />the State is being requested in the identification of the alluvial <br />valley floors. as required by the coat regulations. <br />Criterion N~anber 20: State Cri taria <br />Analysis: <br />Colorado. <br />CONCLUSION: <br />No State criteria have been proposed or adopted by <br />Four areas were considered unsuitable for surface mining. However. <br />after exceptions to the criteria ~+ere applied. they were considered <br />' suitable with stipulations. The areas are: (7) golden eagle nest site, <br />T135. R90M, Sec. 31, NW1/4 MW1/4, 6th P.M. (2) Cooper's Nawk nest site. <br />T13S, R90W. Sac. 16. 5111/4 5E1/4 NWT/4 (3) all the riparian zones and <br />(4) the aquatic habitat of the North Fork of the Gunnison River. <br />The stipulations ors: <br />(1) Surface facilities. occupancy, surface disturbance, industrial <br />fires and subsidence will net ba permitted in the eagle or Cooper's <br />Hawk nests buffer zones. Some surface activities may be permissible <br />in the buffer mna at times other than the breading rearing season <br />or 1 f the nests are i nacti w. <br />(2) Surface disturbance in the North Fork of the Gunnison River <br />affecting aquatic habiLt will not ba permitted.- Surface distur- <br />bance includes surface facilities. subsidence channel modifications <br />and reduction of water quality. Soar activities mey be permitted <br />1n the stream habitat with approval of the Division of W11d1ife <br />Resources. <br />- ~- <br />
