III IIIIII III IIII III <br />SJe have received your draft Biological Opinion for the construction <br />and operation of the Coal Ridge No. 1 Mine near New Castle, Co., and <br />agree with your assessment of minimal impact to endangered species. <br />With regard to endangered fish species, Storm King Mines will commit <br />to the one time donation of $5,313.43 to the conservation fund for <br />research and management planning of threatened and endangered <br />species. This commitment will offset any potential impact of with- <br />drawal of 356 acre-feet annually on the fish species considered. <br />In regard to the bald eagle perch/roost trees, Storm King will also <br />make every effort to avoid all riparian trees in excess of 12 inches <br />diameter at breast height, during construction of the rail.spur <br />and other surface facilities.. <br />Please let us know if you have any questions, I remain <br />Yours truly, <br />E.
