<br />6. All procedures detailed in the "Programmatic Memorandum of Agreement Among <br />the Department of the Interior, Bureau of Land Management, Office of Surface <br />Mining Reclamation and Enforcement, Geological Survey, and The Advisory <br />Council on Historic Preservation Regarding the Federal Coal Management <br />Program" will be followed. <br />7. Before the approval of a mining plan, the authorized officer may require a <br />. survey of all or part of the leased land to provide an inventory of any <br />historical, cultural, paleontological, and archaeological values. The survey <br />will be conducted by a qualified professional paleontologist or archaeologist, <br />approved by the authorized offier, and a report of the survey will be <br />submitted to the authorized officer. The approval of an exploration or mining <br />plan or the continuation of lease operations may be conditioned on the <br />approval of the survey report and the approval of measures to protect the <br />historical, cultural, paleontological, and archaeological values. The cost of <br />arly survey or measures to protect such values discovered as a result of the <br />survey will be borne by the lessee and items and features of historical, <br />cultural, paleontological, or archaeological value will remain under the <br />jurisdiction of the United States. <br />8. If any items or features of historical, cultural, paleontological, or <br />archaeological value are discovered during lease operations, the lessee will <br />immediately notify the mining supervisor and shall not disturb such items or <br />features until the mining supervisor issues instructions. If the lessee is <br />ordered to take measures to protect any items or features of historical, <br />cultural, paleontological, or archaeological value discovered during lease <br />operations, the cost of the measures will be borne by the lessor and such <br />items and feature will remain under the jurisdiction of the United States. <br />9. No surface activities will occur within the three golden eagle nest buffer <br />zones from December 15 to July 31. The mine surface features within the <br />buffer zones must not impair the site for nesting golden eagles and must be <br />approved by the BLM. <br />10. No surface activities shall occur within the falcon cliff nesting site <br />buffer zone. <br />DESCRIPTION OF THE MINING AREAS <br />The current mining area and the three proposed lease areas are approximately <br />12 miles north of Fruita, Colorado. The locations are shown on map 1; <br />coordinates and total acres are given in tahle 1. <br />• Current mining operations on privately owned land include entrance facilities, <br />shops, and temporary offices covering approximately 40 acres. Additional <br />facilities would be constructed for: 1) shops, offices, change rooms and other <br />_ support facilities; 2) loadout facility; 3) preparation plant; 4) additional <br />mine openings; 5) disposal areas; 6) storage pond and pumping stations; and 7) <br />transportation and utility structures. Total disturbed surface area for the <br />mine entrance facilities and other surface facilities would be 120 acres. <br />Total acres disturbed for transportation route would be approximately 75 <br />acres. <br />2-5 <br />
