Crit=_ricn Cu-~ber 17 <br />Iunicipal Watersheds <br />Analysis: I:o municipal watersheds have been identified as lying <br />within these coal leases. <br />Criterion Number 18: Jational Resource Idaters <br />Analysis: The State of Colorado is presently working on the project <br />of identifying and labeling National Resource 4Jaters. As part of <br />their definition of National Resource ldaters, a stream must have <br />perennial or continuous flow and be of high quality, capable of _. <br />supporting trout fisheries. To date, no water courses in the lease <br />area have been officially designated as National Resource Waters in <br />completed water quality management plans. <br />Criterion Number 19: Alluvial Valley Floors <br />Analysis: The area to which the unsuitability analysis was applied <br />may have an alluvial valley floor present on the alluvial terraces <br />adjacent to the North Fork of the Gunnison River. Assistance from <br />the State is being requested in the identification of the alluvia l <br />valley floors, as required by the coal regulations. <br />Criterion Number 20: State Criteria <br />Analysis: tJo.State criteria have been proposed or adopted by <br />Colorado. <br />CONCLUSION: <br />Four areas were considered unsuitable for surface mining. However, <br />after er,ceptions to the criteria were applied, they were considered <br />suitable with stipulations. The areas are: (1) golden eagle nest site, <br />T13S, R90W, Sec. 31, Nl•J1/4 NIJI/4, 6th P.M. (2) Cooper's Hawk nest site, <br />7135, R90W, Sec. 16, SYl1/4 SE1/4 h11J1/4 (3) all the riparian zones and <br />(4) the aquatic habitat of the North Fork of the funnison River. <br />The stipulations are: <br />(1) Surface facilities, occupancy, surface disturbance, industrial <br />fires and subsidence will not be permitted in the eagle or Cooper's <br />Hawk nests buffer zones. Some surface activities may be permissible <br />in the buffer zone at times other than the breeding/rearing season <br />or if the nests are inactive. <br />(2) Surface disturbance in the North Fork of the Gunnison River <br />affecting aquatic habitat will not be permitted. Surface distur- <br />bance includes surface facilities, subsidence channel modifications <br />and reduction of water quality. Some activities may be permitted <br />in the stream habitat with approval of the Division of Wildlife <br />Resources. <br />
