Should a resource be determined eligible for listing in the National Register of Historic Places, the operator shall consult with and obtain the approval of the regulatory authority concerning the development and implementation of mitigation measures as appropriate. 45. The operator shall ensure [hat a sample survey for cultural resources is performed on all areas where there is the potential for subsidence. Emphasis should be directed towards the determination of Che presence or absence of sites which may be sensitive [o the adverse effects of subsidence, e.g., historic and prehistoric structures and/or structural remains, rock shelters, and rock art sites. If such resouces are located, further surveys may be necessary. 46.
