The amended <br />subsidence evaluation shall include the proposal of appropriate <br />subsidence monitoring networks within each of these critical areas. <br />817.150 Roads and Other Transportation <br />43. Prior to any construction or surface disturbance to facilitate coal <br />mining within 100 feet of a road right of way, ARCO will receive a <br />variance to do so from the regulatory authority. <br />Cultural Resources <br />44, During mining operations if any previously uniden[ifed cultural resources <br />should be discovered, [he operator shall ensure [hat the site is not <br />disturbed and shall notify the regulatory authority. The operator shall <br />ensure that the resource(s) is properly evaluated in terms of the <br />National Register of Historic Places eligibility criteria (36 CFR 60.6). <br />Should a resource be determined eligible for listing in the National <br />Register of Historic Places, the operator shall consult with and obtain <br />the approval of the regulatory authority concerning the development and <br />implementation of mitigation measures as appropriate. <br />45. The operator shall ensure [hat a sample survey for cultural resources is <br />performed on all areas where there is the potential for subsidence. <br />Emphasis should be directed towards the determination of Che presence or <br />absence of sites which may be sensitive [o the adverse effects of <br />subsidence, e.g., historic and prehistoric structures and/or structural <br />remains, rock shelters, and rock art sites. If such resouces are <br />located, further surveys may be necessary. <br />46. Should sites which may be sensitive to subsidence be located, [he <br />operator will consult with the regulatory authority to determine whether <br />mitigation measures or monitoring activities are necessary [o either <br />avoid adverse impacts or to determine whether [he site will be impacted <br />by subsidence. <br />870 Subchapter R Reclamation Fees <br />47.
