Flanla, <br />Division Director <br />The Division has reviewetl your request for a Board hearing regarding the <br />proposed Rimrock Mine Permit. <br />Most of the issues raised in you initial letter of September 28, 1990 are <br />outside the jurisdiction of the Mined Land Reclamation Division, However, <br />there are some technical issues raiseo in your letter of October 1, 1990, <br />These issues have been resolved to the satisfaction of the Division, It is <br />unfortunate that the copy of the permit application at the court house was not <br />upaated to refleci those changes. The permit application in the court house <br />will be updated by 10/5/90 to reflect all the changes, <br />At this time it will be impossible to meet the legal notice time frames for <br />holding the hearing at the regular monthly meeting of the Mined Land <br />Reclamation Board in October, Therefore, the Division proposes to schedule <br />the formal public nearing for the November Board meeting. In order to <br />schedule the hearing for the November Board meeting, we ask that you write a <br />letter to the Division waiving your right to have a hearing within thirty days <br />of your written request. The decision on the permit to mine will not be final <br />until you have a chance to present your case in front of the Board, <br />Between now and the date of the Board hearing, the Division would like to <br />propose a meeting in Denver with your representatives, At this meeting the <br />Division will try to resolve the technical and other related issues that could <br />be addressed by MLRD. <br />If you have adaitional questions or concerns please call, <br />Sincerely, <br />-_ <br />Dan T.
