In said plan Energy Fuels Corporation indicated that <br />The Pittsburg & Midway Coal Mining Co. (P&M) had assigned to Energy Fuels <br />Corporation P&M's mineral interest in certain coal reserves located in the <br />SE; of the SW; and the SW; of the SE; of Section 13, Township 5N, Range <br />86W which P&M has leased from the State of Colorado by virtue of State Lease <br />265-13-5. <br />P&M has not assigned any of its interests in the aforedescribed coal reserves <br />to Energy Fuels Corporation or any other party. Further, P&M has no present <br />plans or agreement with Energy Fuels Corporation to assign the interests in <br />said coal reserves to Energy Fuels Corporation. <br />If you have any further questions in this matter, do not hesitate to contact <br />me. <br />Sincerely, <br />U ~G <br />John A.
