Lang <br />Division Director <br />RE: Fruita #1 and #2, (C-81-015); Extension of Time for Abatement <br />for NOV-C-91-024, and Settlement Agreement of <br />December 16, 1992. <br />Dear Mr. Crichton: <br />Enclosed please find a copy of the extension of time for abatement <br />of NOV-C-91-024. This extension has been granted while rule-making <br />processes are ongoing for Rule 4.14. Please be advised that the <br />Division has withdrawn the proposed decision to approve American <br />Shield Coal Company's application for a reclamation only permit <br />pending finalization of this rule change. <br />Also, included with this letter is a copy of the Settlement <br />Agreement presented to the Mined Land Reclamation Board on December <br />16, 1992. This Settlement Agreement amends the March 25, 1992 <br />Settlement Agreement by extending the date American Shield Coal <br />Company is required to obtain a reclamation only permit for the <br />Fruita No. 1 and 2 Mines until ten days after the rule change of <br />Rule 4.14 is final.
