Barry, II I, <br />Director <br />April 3, 2980 <br />TO: Linda Walker <br />FROM: Jim Pendleton <br />RE: Grand Mesa al's use Disposal Plan <br />Sections 717.15, 717.14(a)(1) and 715.15 of the interim federal regulation <br />address the surface disposal of underground spoil and waste materials. <br />The refuse disposal plan proposed by Grand Mesa Coal fails to conform <br />adequately with those interim regulations. <br />Waste and spoil materials should not be placed beneath the standing water <br />table. In this instance, the applicant could:. (1) install a gravity <br />drain system daylighting downslope; (2) limit disposal of coal containing <br />waste and refuse to above the standing water table, placing only non-coal <br />containing waste below the water table; or (3) limit the placement of <br />coal containing waste to dry excavations other than the strip pits. <br />Zn order to achieve proper compaction, backfilled material should not be <br />placed in standing water. The strip pit should be de-watered before <br />non-coal containing material is placed. Waters obtained from de-watering <br />could be utilized to moisten dry materials prior to placement or to <br />control dust. In accord with section 715.15(a)(9), the fill must "be <br />inspected for stability by a registered engineer, or other qualified <br />professional specialist during critical construction periods to assure <br />removal of all organic material and topsoil, placement of under-drainage <br />systems, and proper construction of terraces according to the approved <br />plan." <br />The application, as reviewed is confusing and lacking in detail. The <br />applicant should amend the plan proposal to reflect the above requirements <br />and to clearly specify the nature of the material to be placed. <br />Jim Pendleton <br />/k <br />
