This mine is permitted with the Mined Land <br />Reclamation Board under Permit No. 76-16, which permit also <br />covers EFC's Pit 3 surface operation. <br />We would like to meet with you or an appropriate <br />staff person to discuss any procedures that EFC may need to <br />pursue in order to preserve the permitted status of the <br />Middle Creek mine and to maintain compliance with applicable <br />provisions of Permit No. 76-16. Specificially, we want to <br />explore the potential applicability of Section 34-32-103(6)(a) <br />C.R.S. 1973, as amended. It is EFC 's present belief that the <br />Middle Creek mining operation can be reopened, however, it <br />is impossible for us to accurately predict at this time when <br />that reopening would occur. <br />Please contact me at your earliest convenience to <br />arrange for a meeting.
