In its application, HGTI addressed the impact of mining at the HG Loadout on fish <br />and wildlife resources, including its impact upon threatened and endangered <br />species (Please see Volume 2, Tab 21 of the HGTI permit application). HGTI drew <br />the following conclusions: <br />1. No additional [now, better described ae "no significant"] land <br />disturbances associated with operation of the loadout are <br />contemplated. No net loss of existing habitat or physical shelters <br />will occur. No additional barriers will be constructed to restrict <br />wildlife travel. <br />2. No wildlife migration routes tranaect the permit area, and the <br />permit area (including the rail spur) has been fenced. <br />3. No unique habitats of high quality, or habitats critical to the <br />existence of any threatened or endangered animal or plant species <br />listed or proposed to be listed by the State or Secretary of <br />Interior exist in the permit area. <br />4. No threatened or endangered animal or plant species listed or <br />proposed to be listed by the State or Secretary of Interior occur in <br />the permit area. <br />5. The fish and wildlife habitats which occur naturally in the permit <br />area are in relatively poor condition due to land uses surrounding <br />the permit area (e.g., proximate urban areas, livestock grazing, and <br />agricultural activities). <br />6. No water quality problems have been identified at the pre-existing <br />sediment control ponds. <br />7. Power lines were installed by Yampa Valley Electric Association and <br />conform to local, State and Federal regulations (Source: Permit <br />Application Package for Permit No. C-80-003, volume I, Section <br />2.05.6). <br />In reviewing HGTI's application, four concerns related to the fish and wildlife <br />related resource were mentioned by the Division of Minerals and Geology in our <br />letter of preliminary adequacy concerns (Preliminary Adequacy Report). Acuatic Habitat <br />Aquatic habitats are described on page 4, Tab 11 but are not delineated on <br />Exhibit 11-1. <br />Please delineate aquatic habitats on Exhibit 11-1, including an explanation in <br />the key. <br />19. Possible Presence of Threatened and Endancered Species <br />The possible presence of threatened and endangered species is not fully addressed <br />or listed in the section of the permit application entitled, "Fish and Wildlife <br />Resources". The first paragraph of the section of the permit entitled <br />"Threatened or Endangered Species" includes a statement that "No federally listed <br />
