The cross-sections (EXHIBITS 12-5R1 and 12-5R2) and the Postmining <br />Topography Map {EXHIBIT 13-2), clearly depict the permanent deposition of the <br />box cut spoils outside the mined pit boundaries. These same EXHIBITS depict <br />a deficit of material at the southern terminous of the northern resource area, <br />resulting in a lowered postmining topography and steeper transitional slopes. <br />The application also demonstrates that the bulking factor averages 0.92, which <br />projects no excess spoil generation. <br />In order to comply with the requirements of Rule 4.14.1(2)(d), refered to by <br />Rule 2.05.4(2)(c), the applicant must demonstrate "that such material is not <br />required to achieve the approximate original contour of the area..." <br />J <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
