Ylu:E 2
5. Reclamation wets to covor the proposed reclamation plan in the event
AR00 dose not develop thn area should be given,
6. In the application form, you indicate that U. S. Steal owns part of
the affected land, while the lease given to ua is only between Bear
and ARCD.
Aa I'm Burn you are aware, the new Pederal Surfaea Mining and Control Act
of 1977 and the Associated Regulations published on December 13, 1977
contain provisions concerning undergro~md coal mines. 'i1~e Colorado 4tined
Land Reclamation Aonrd cannot approve a permit whose terms are not in
conformance with nll "Federal, State and Local laws" (115 (4)). Many
operators have elected to include an addendum to their permits to ehaw how
their plan complies with each section of the regulations. By so doing,
Chey are allowing the State to enforce the Federal rules rather than having
straight Federal enforce+runnt. I could certainly advise you to take Ctrs
same approach.
Please contact me if ;~oii have an}• gt:cstions what..^,oevcr.
Sincerely,
Dean R. :Massey
Heclamniion Specialist
DK.'f: pas
Encl: ae stated

i N ~~ ~ . ~~ ~~~
