PLANNER RE: New Castle Energy Corporation pending special use permit application Dear Mark: Please include in your/the county's deliberation of our special use permit application an amendment. The amendment relates itself to the Corporation's intent to locate a temporary intake, pump, and pipeline facilities within the COS zoned area on the south bank of the Colorado River. The facility would pump approximately 1.0 cfs intermittently as needed for mine construction activities. We understand that the COS zone includes as a special use a site for power or water utilities. While the installation we propose is purely temporary and would involve no permanent construction or restoration activities, we nonetheless thought to be safe it would be appropriate to request the county to approve this as a potential water utility location. The legal description of our proposed point of diversion is as follows: The diversion will be from the Colorado River at a point located in the S.E. 1/4, S.E. 1/4 of Section 33, T. 5 S., R. 90 w., of the 6th P.M., more particularly described at a point whence the S.E. corner of said section bears N. 89°48' E. a distance of 250 feet.
