The Fruita Mine complex has not been <br />in operation since 1980. In the winter of 1990 and 1991 the site <br />was backfilled and graded and OMLR granted a partial bond release <br />for the completed work. Due to the fact that the mine bench had <br />been constructed prior to the enactment of CSCMRA, 30-50 foot <br />highwalls remain after backfiliing and grading work. The Mine site <br />is located within the Bookcliffs formation. During the Fall of 1991 <br />the site was seeded with a seedmix approved by OMLR. <br />The Mine has never received an approved permit from OMLR. <br />Regulation 2.07.6(n) requires that our Division contact your office <br />for your assessment of how this operation may affect threatened and <br />endangered species. Since this site is already in a reclaimed <br />status no new disturbance shall occur during the proposed 5 year <br />permit term. Maintenance of existing structures required by the <br />Division should be the only activity occurring on the site. <br />The location of the reclaimed mine site is: <br />Township 8 South, Range 101 West of the 6th Principle Meridian <br />NW 1/4 NW 1/4 Section 29 <br />NE 1/4 Section 30 <br />
