Long <br />From: David Be Drcismn Director <br />Re: Bowie No. 2 Application <br />Today I spoke with Larry Kline of the Office of Surface Mining, and I inquired whether the Bowie <br />No. 2 Mine will be a "federal" or "private" mine for the purposes of oversight and interagency <br />coordination. I told Larry that the coal to be mined and the surface overlying the coal are private. <br />I also stated that the permit boundary includes federal surface due to the angle-of-draw projections. <br />Additionally, I stated that federal coal ]ease coal lies directly adjacent to the private coal to be <br />mined, and that angle-of-draw impacts could occur in the unmined adjacent federal coal. <br />Larry checked with Rick Holbrook, and Larry has indicated the mine will not involve a federal <br />mine plan approval, and the mine will not be considered a "federal" mine. I told Larry that it <br />might be a good idea to double check with his inspection people to ensure that they do not have a <br />different opinion, given past interpretations from AFO. He will double check and let us know if <br />something changes. <br />For now, tell Stover not to send the package to OSM.
