-6- <br />The proposed operation is in compliance. <br />II. Land Use - Rules 2.04.3, 2.05.5 and 4.16 <br />The previous use of the land has been industrial. The operator is proposing <br />to return the area to an industrial land use. The current land owner has no <br />objection to this land use. <br />The proposed operation is in compliance with the requirements of this section. <br />III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br />The applicant has provided information on cultural and historic resources in <br />the permit application. <br />Pursuant to Rule 2.07.6(2)(e), the Division finds that the proposed operation <br />will not adversely affect any publicly owned park or place listed in the <br />National Register of Historic Places. <br />The proposed operation is in compliance with the requirements of this section. <br />IV. Geology - Rules 2.04.5 and 2.04.6(2) <br />A geology description is located on Page 2.04.6-1 of the permit application. <br />The Mt. Harris loadout is located in an alluvial terrace adjacent to the <br />Yampa River. This terrace consists of a deep layer of unconsolidated boulders <br />and cobbles overlying bedrock. The exact thickness of this deposit is not <br />known. Since no mining or further excavation will take place, this material <br />will not be disturbed. <br />The proposed operation is in compliance with the requirements of this section. <br />V. Hydrologic Balance: Surface Water Rules 2.04.5, 2.04.7, 2.05.3 <br />The surface water hydrology section, sediment control plan and hydrologic <br />balance sections of the application have been reviewed by the Division. <br />Information on these subjects is found in Sections 2.04, 2.05 and 4.05 of the <br />permit application. <br />The entire area is drained by the Yampa River. All surface flow from adjacent <br />areas will be diverted around the permit area. A berm will be constructed <br />around the area and will contain all surface water on site. The outslope of <br />the berm will be vegetated to reduce possible sedimentation. The original <br />application called for the construction of a sediment pond. Since the <br />operator will only be reclaiming the site, it is felt that a sediment pond is <br />not necessary. There will be no runoff from the site. All surface water will <br />be contained within the berm. <br />The proposed operation is in compliance with the requirements of this section. <br />
