Dept. of i:'~tural Resr..urr;1! <br />Chimney Rock Coal desires to submit an application to mine <br />Federal coal adjacent to the present permit area. As <br />discussed in your office a few weeks ago, this area is <br />presently being reviewed by the BLM under the emergency <br />leasing criteria. It will be advantageous for Chimney Rock <br />to begin mining this coal during the third quarter of 1983. <br />Presently there is no legal right of entry for this area. <br />However, attached is a memorandum from the BLM case file. <br />This states that Chimney Rock Coal's application does meet <br />the emergency coal lease criteria. The BLM has completed <br />their environmental assessment and a public hearing is <br />scheduled for January 25, 1983. <br />To allow for proper permitting time, I therefore request that <br />Chimney Rock be allowed to submit a permit application during <br />January 1983. <br />If you have further questions, please call me or Doran <br />Gillette with the Bureau of Land Management.
