Shelton <br />Director <br />April 6, 1982 <br />Mr. John Wiggins <br />Route 2, Box 80-C <br />Trinidad, Colorado 81082 <br />Re: Trinidad Basin Mining, Inc. proposed permit area and mining operation. <br />Dear Mr. Wiggins: <br />I have received your comments regarding your tract of land and homestead. I <br />have reviewed the proposed permit area for the Trinidad Basin Mine and your <br />property is included in that area. <br />The Division cannot grant a permit to Trinidad Basin Mining without a demon- <br />stration by the company that they have secured the legal right to enter the property <br />and conduct surface coal mining and reclamation operations (Rule 2.07. 6(2)(f)). <br />If you wish, you have the right [o request an informal public hearing to <br />discuss this matter with representatives of the Division and the mining <br />operation. To do so you must request the conference in writing and specifically <br />state the issue(s) to be raised and discussed, and whether you would like <br />the conference to be held in the vicinity of the mine site. The conference <br />would be held within'60 days of the last publication notice. <br />Another finding the Division must make in order to issue a permit to this <br />mining operation is that the operator has the permission of the owner to <br />mine within 300' of an occupied dwelling. The Division is in receipt of a <br />letter from Mr. Alvin Wiggins conveying that right'to Trinidad Basin Mining. <br />From your deed it appears that you are the owner of the residence in section <br />15, T315, R65W.
