The Seneca II-W mine is located within the drainage basin of the Upper <br />Colorado River, as defined by the U.S. Fish and Wildlife Service (FWS). <br />All projects requiring Federal approval in the IIpper Colorado River basin <br />must take part in the FWS's Windy Gap process. This process is an <br />evaluation of the cumulative effects of depletions on endangered species <br />of fish in the basin. Therefore, Peabody must provide a calculation of <br />the total depletion of surface flow tributary to any stream in the basin, <br />as a result of operations at this proposed mine. <br />4. Appendix 3-5 indicates several unabated violations at other Peabody <br />mines. These violations must be abated to prevent delays in approval. <br />5. There is no evidence, with the exception of the aerial big game <br />survey, that site specific data were collected for the cross-tie haul <br />road habitats. Site specific information on raptor nesting, prairie dog <br />colonies, etc. must be discussed to document claims of no effect on <br />threatened and endangered species or to develop appropriate mitigation. <br />6. In addition to the REA Bulletin 61-10 for safe powerline design, you <br />may wish to refer the applicant to the following publication which is now <br />considered by the U.S. Fish and Wildlife Service to be the best <br />technology currently available for safety of raptors and other large <br />birds. <br />of the Art in 1981 by Olendorff, et al.
