The list of species for the assessment included the
following:
bald eagle
peregrine falcon
Colorado squawfish
razorback sucker
bonytail
humpback chub
southwestern willow flycatcher
(HaliaePtua 1PUnocPnhaltc)
(Falco ~regrinus)
(myc-hochei 1LC ]~iyy~)
(~(yrauchen texanus)
(f:i l a sr]tuha)
(Fmk idenax ra' 11 i i PYtimy~,c_)
OSM subsequently received the U.S. Fish and Wildlife Service's
biological opinion (GJ-6-CO-96-F-11) on 9-3-96. The USFWS
concurred with OSM's "no effect" finding for the bald eagle,
peregrine falcon, and the southwestern willow flycatcher. The
USFWS also determined that the project water depletion impacts
(121.8 acre feet/year) could be offset by Bowie Resources Limited
(BRL) contributing a one time depletion charge of $1,588.27
($13.04 per acre-foot) to the National Fish and Wildlife
Foundation.
On 11-13-96, the Colorado Division of Minerals and Geology
requested that OSM reinitiate Section 7 consultation because BRL
had submitted additional calculations to include evaporative loss
from the proposed sediment ponds. Evaporative loss was estimated
at 34-inches per year and is quantified as follows:
