Colorado Yampa Coal Company - Energy No. 3 Mine
Dear Mr. Simpson:
Per our discussion of October 3, 1983, this letter is a request for WQCD's
opinion on the necessity of the above-referenced operator obtaining an NPDES
permit.
CYCC, a subsidiary of Getty Coal Company, submitted a technical revision to
our office on September 9, 1983 requesting approval to construct two
sedimentation ponds at the Energy No. 3 Mine.
The "Middle Creek detention pond" is to be located at the Middle Creek Mine.
The area consists of an open pit, two large overburden stockpiles, a haul
road, and level storage/parking lot. The area is unreclaimed and unvegetated.
The second pond is the "No. 3 Mine detention pit" and collects runoff from the
surface mine area. Most of this area (excess of 80 acres) is regraded spoil
that, as of September, was untopsoiled and unvegetated. The mine application
on file at the Division (pending) proposes to mine an additional 200,000 tons
of coal within the area controlled by the sedimentation pond.
We request you render an opinion as to whether NPDES permits will be needed
for these ponds. I have attached a map of the area to assist you on the
