Following are BRL's <br />responses to the DWR comments. <br />1. No response required. <br />2. The DWR indicates that in fact there is a difference in drill <br />hole sealing requirements between the DWR and the DMG. By <br />separate letter to the DWR, copy enclosed, BRL has requested <br />a variance from the DWR sealing requirements so it can employ <br />the DMG sealing requirements. <br />3. The DWR indicates some ditch systems prefer (and sometimes <br />rely on) silty water to "lubricate" and seal their ditch <br />delivery system. <br />The Deer Trail Ditch and Fire Mountain Canal obtain water from <br />Hubbard Creek and the North Fork of the Gunnison River <br />respectively. The creek and the river have significant <br />sediment load during spring run-off and during significant <br />area wide precipitation events. <br />The amount of water contributed to these irrigation ditches <br />from the two ephemeral drainages, the run-off from which will <br />be controlled by sediment ponds, is negligible. During 1995, <br />there was no flow noted from either of the drainages. <br />The sediment ponds to be constructed by BRL will protect the <br />Deer Trail Ditch and Fire Mountain Canal from the effects of <br />run-off from a significant precipitation event that could <br />actually plug or dam the Deer Trail Ditch because of its small <br />size and possibly damage the Fire Mountain Canal. <br />
