2. Term. The term of this Agreement shall be for a period of two (2) months <br /> commencing on the effective date hereof and ending at 12:00 midnight on <br /> - , unless terminated earlier as provided for hereinafter. Licensee <br /> sliall be entitled to enter the Premises following the effective date of the <br /> Agreement and upon execution of the Agreement by Licensor and Licensee. <br /> This Agreement may be terminated sooner as follows: <br /> (a) Licensee may terminate this Agreement for any reason or no reason <br /> whatsoever upon thirty (30) days' prior written notice to Licensor; <br /> (b) Licensor may terminate this Agreement for Licensee's breach of any of <br /> the terms and conditions of this Agreement, as provided hereinafter. <br /> 3. Allowed Use/Restrictions <br /> (a) The grant to Licensee under paragraph 1 herein shall extend to its <br /> employees, contractors and subcontractors, e � of whom(shall be <br /> obligated under the terms of the Agreement. 5 <br /> V) ,319 <br /> (b) Licensee, its employees, contractors and subcontractors shall comply <br /> with all applicable laws, rules, regulations and permitting requirements, <br /> including those concerning reclamation and environmental matters, of <br /> any lawful federal, state or local governmental authority which apply to <br /> its use of the Premises for the stated purposes; <br /> (c) The right of ingress and egress, pursuant to paragraph 1 herein, to and <br /> from the Premises, on or across the existing roads of Licensor connecting <br /> said Premises to the nearest public road or roads, includes the right to <br /> transport on, over and across the Premises such supplies, materials and <br /> equipment necessary to support Licensee's activities on the Premises; <br /> (d) Licensee agrees that all of the work performed under this Agreement, <br /> whether performed by itself or its employees, contractors and <br /> subcontractors, shall be performed in a good and workmanlike manner, <br /> and that all rubbish, waste, debris and excess material and equipment <br /> shall be kept in a neat, safe and orderly condition; <br /> (e) Licensee agrees that all operations performed by Licensee hereunder, or <br /> its employees, contractors or subcontractors shall be at the sole risk and <br /> expense of Licensee; <br /> (f) Licensee shall give all necessary notices and obtain all required permits <br /> and shall comply and ensure that all of its employees, contractors and <br /> subcontractors comply with all applicable federal, state and local laws, <br /> ordinances, governmental rules and regulations relative to the operations <br /> under this Agreement, including those relating to the preservation of the <br /> public health and safety and those within the Federal Mine Safety and <br /> Health Act (MSHA).
