Even when mining is completed, approxi- <br />mately .3 cfs will continue infiltrating into the mine causing additional injury <br />to Pioneer Ditch and other users. <br />Based on the above discussion, we recommend that MLRD make a stipulation in <br />the mining permit for Snowmass Coal requiring Snowmass Coal to file a plan for <br />augmentation in Division 5 Water Court within 180 days. The plan for augmen- <br />tation should provide for replacement of all water lost to the surface system dur- <br />ing periods of administration because of the mining operation. The plan should <br />continue until the mine is filled with water; and therefore, there is no further <br />infiltration into the mine. <br />Snowmass must also obtain a well permit from our office to comply with CRS 1973, <br />37-90-137. Snowmass will be unable to obtain this permit until they have an <br />approved plan of augmentation. <br />If our office can be of further assistance, feel free to contact us.
