Uept. of Natural Resources <br />Re: Request For Variance From Approximate <br />Original Contour Requirements - <br />Munger Canyon, File No. C-020-81. <br />Dear Brian: <br />This request supercedes and replaces the original request for <br />variance submitted to you on August 20, ]982, and is intended to <br />constitute a formal request for a variance from Approximate Original <br />Contour (AOC) requirements pursuant to the Colorado Coal Mining and Re- <br />clamation Regulations, § 2.06.5. This provision allows for the approval <br />of certain exceptions to the AOC requirements. <br />This variance request is not used to present new facts, only to <br />identify the appropriateness of the variance through summation of <br />previously submitted data provided in the referenced application, and <br />the compliance with the intent and principle of AOC. <br />The requested variance is for the area in and around the work-bench <br />site and the access road to that site. The road had to be cut into the <br />hillside to allow for logical access to the coal seam and two (2) of the <br />six (6) issued Federal coal leases, and to provide a means of necessary <br />coal haulage. The features are shown in detail in Figures 2.2-2, 2.2-4, <br />2.2-8 through 2.2-14 and 3.1-1 of the referenced application. <br />This request for variance is based upon conformance with the existing <br />reclamation plan contained in the application. Information contained in <br />the referenced application shows that erosion is adequately controlled and <br />failure of the reclaimed area is prevented. The topography as described <br />in the reclamation plan "closely resembles the general surface configura- <br />tion of the land prior to mining and blends into and complements the <br />draining pattern of the surrounding terrain". The postmining topography <br />is shown to be stable and capable of supporting anticipated land use. <br />._..~ <br />
