3. That applicant shall enter into an agreement with the County of Jackson,
i State of Colorado, regarding the present and future repair and/or maintenance of
Jackson County Roads 10 and 19.
4. That, in the event operations under said permit interrupt or disturb
any public highway or road traversing said tract, applicant shall make provision
for alternate routes of travel and shall establish road ways and traffic patterns
comparable to those interrupted or distured at its own expense.
5. That applicant shall enter into an agreement with the Division of Wildlife,
State of Colorado regarding the procedures and steps that will be taken to protect
and minimize any adverse affects of the proposed mining operations on the sage ~°
grouse population and any other identified critical wildlife areas which may be /f
affected by said proposed mining operations. Said agreement shall be subject to
review by this Board and approval by this Board of the terms and conditions contained
therein.
6. That any operation conducted pursuant to said permit be restricted to an
area of not more than One Hundred and Twenty (120) acres, together with all
necessary haul roads, which affected lands shall be described by surveys submitted
to this Board and designated by boundary stakes on the site. That any change in
boundaries or location of the operation be preceded by submission of a survey to
this Board, and approval thereof, locating the new site.
7. That applicant shall enter into an agreement with the County of Jackson,
State of Colorado, regarding front-end financing to minimize any social and/or
economic impacts on the Town of Walden, County of Jackson, and/or its residents.
8. That the Special Use Permit issued hereunder shall terminate upon a
finding by this Board that commercial production on said tract has ceased for a
eriod of one (1) year, unless an extension is otherwise authorized by this Board.
9. That said Special Use Permit shall become effective only upon compliance
with the above-referenced conditions and restrictions and upon execution of the
above-referenced agreements.
10. Any work and/or construction associated with the operations or uses on
the land described herein shall be performed in conformity with the Jackson County
Zoning Resolution and all other applicable regulations and in compliance with all
terms and conditions imposed herein on the authorization for the special use by
the Board of County Commissioners of Jackson County.
Adopted by the Board of County Commissioners of Jackson County, Colorado, this
22nd day of October, 1979.
