<br /> <br />Calculation of the bond is a critical issue in the permitting process. <br />This information is necessary for determing costs accurately. <br />8. If any additional aquifers are identified in the area, as per the `~ <br />information requested under parts 2.04.7(1) and (3) a plan for the ~~ <br />/` restoration of the approximate recharge capacity of the aquifer(s) in <br />~t accordance with Section 4.05.12 should be submitted to the Division. <br />~~'~ ~ Also, a plan should be submitted including measures to be taken during <br />\~~~ and after the proposed mining activities, in accordance with Section 4.05, <br />to ensure the protection of the quality of the ground water system from <br />the adverse affects of the mining activities. <br />2.05.5 Post-Mining Land Use <br />The applicant must provide comments from the owner of record of the disturbed <br />surface approving retention of the specified portion of the road, permanent <br />diversion channel, and permanent waste dump. These comments must also <br />approve the proposed post-mining land use. Please provide these comments <br />to conform with 2.05.5(2)(b). <br />2.05.6(1) Air Pollution Control Plan <br />1. No copy of the emissions permit no. C-11, 725(FD) or its application <br />was included in Appendix E. <br />2. According to the narrative, the emissions permit only covers the use <br />of the conveyor, crusher, and surface work vehicles. The permit and the <br />application as submitted do not address the controlling of fugitive dust <br />from coal stockpiles, loaded trucks, coal transferring and coal Zoading <br />points. <br />3. Available total suspended particulate (TSP) data collected on site <br />should be provided if data for one or more quarters is available. Locations <br />of all monitoring sites should be shown on a site map. <br />2.05.6(2) Fish and Wildlife Plan <br />1. Are any power Zines proposed for use within the permit areas? <br />2. The monitoring program described on pp. 9-33 to 9-35 of the mine plan <br />should provide data of considerable value. Does the applicant intend to <br />submit this data to the regulatory authority on an annual basis? <br />2.05.6(3) Protection of Hydrologic Balance <br />I. Page 2-50 (Section 2. 5) discusses the water quality monitoring program. <br />This discussion should be more definitive by stating: (1) the method of <br />collection and reporting of data, and (2) that flow data will be monitored <br />and reported to the regulatory authority. These items should be submitted <br />to comply with Section 2.05.6 of the approved Colorado program. <br />2. The reclamation plan does not adequately address how the permanent <br />diversion will be monitored upon reclamation, to show its effectiveness <br />in controlling erosion and the protection of the hydrologic balance <br />especially through protection of water quality. <br />(9) <br />
